📰 Why in News (April 2026): On 24 April 2026, 7 out of 10 AAP Rajya Sabha MPs — including Raghav Chadha and Sandeep Pathak — announced they were merging with the BJP. The Rajya Sabha Chairman C.P. Radhakrishnan formally recognised the merger on 27 April 2026. AAP's Rajya Sabha strength dropped from 10 to 3 overnight. This sparked a major constitutional debate on whether this was a valid merger or a disguised defection.
  • The Merger Claim: The 7 MPs invoked Paragraph 4 (merger exception) of the Tenth Schedule — 7 of 10 = 70%, which exceeds the 2/3rd threshold required for a valid merger, so they claimed protection from disqualification
  • AAP's Counter-argument: A "merger" under Paragraph 4 requires the original political party to merge — not just the legislative wing. Since AAP as a party did not merge with BJP, AAP leaders argue this is defection disguised as a merger. Sanjay Singh and Chief Whip N.D. Gupta filed disqualification petitions
  • The Legal Grey Area: The law is ambiguous on whether "legislature party" = "political party." Supreme Court may ultimately have to settle this question
